1 Eligibility and Age Requirements

We reserve the right, but do not assume the obligation, to monitor activity and content on the Service and to remove content or restrict access at our sole discretion.
4 User-Generated Content
The Service may permit users to post, upload, or submit content, including sports logs, game notes, venue ratings, photos, and event plans ("User Content"). You retain full ownership of your User Content.
By submitting User Content to the Service, you grant us a non-exclusive, worldwide, royalty-free, transferable license to use, host, store, reproduce, display, and distribute such content solely in connection with the operation, promotion, synchronization, and improvement of the Service.
You represent and warrant that you possess all rights necessary to grant the foregoing license and that your User Content does not violate these Terms or infringe any third-party intellectual property or privacy rights.
5 Intellectual Property
All content, source code, visual designs, trademarks, logos, features, and functionality of the Service (excluding User Content) are the exclusive property of Taylor Gunn and are protected by applicable United States and international copyright, trademark, patent, trade secret, and other intellectual property laws.
No right, title, or interest in or to the Service is transferred to you except as expressly set forth in these Terms.
6 Payments and Subscriptions
The Service offers a freemium model with optional premium features and subscriptions:
Premium Subscription: Premium access is available for fifteen dollars ($15.00) per year. Subscription pricing and billing frequency will be clearly presented prior to purchase.
All payments, transactions, and renewals are processed through third-party payment processors or applicable app store platforms (e.g., Apple App Store). All purchases are non-refundable, to the fullest extent permitted by applicable law and app store terms.
We reserve the right to modify pricing, subscription tiers, or feature availability at any time. Any price changes will apply prospectively to future billing cycles with reasonable advance notice.
7 Disclaimer of Warranties
The Service is provided on an "AS IS" and "AS AVAILABLE" basis. To the fullest extent permitted by law, we disclaim all warranties, whether express, implied, statutory, or otherwise, including without limitation any implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
We do not warrant that the Service will be uninterrupted, error-free, timely, secure, or that any defects or errors will be corrected.
8 Limitation of Liability
To the fullest extent permitted by law, in no event shall Taylor Gunn, affiliates, or licensors be liable for any indirect, incidental, consequential, special, or punitive damages arising out of or relating to your use of or inability to use the Service.
Our total cumulative liability for any and all claims arising under or related to these Terms or the Service shall not exceed the amount paid by you to us during the twelve (12) months preceding the event giving rise to the claim, or $50.00 USD if you have not made any payments.
9 Indemnification
You agree to defend, indemnify, and hold harmless Taylor Gunn from and against any and all claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to your violation of these Terms or your use of the Service, including your User Content.
10 Termination
We reserve the right, in our sole discretion, to suspend or terminate your account or access to all or part of the Service at any time and for any reason, including without limitation for violations of these Terms, without prior notice or liability.
You may terminate your account at any time through the profile settings in the app or by contacting support.
11 Governing Law and Venue
These Terms and any dispute or claim arising out of or related to them shall be governed by and construed in accordance with the internal laws of the State of Alabama, without giving effect to any choice or conflict of law provision or rule.
Any legal suit, action, or proceeding arising out of or related to these Terms or the Service shall be instituted exclusively in the state or federal courts located within the State of Alabama, and each party irrevocably submits to the exclusive jurisdiction of such courts.
12 Changes to These Terms
We reserve the right to revise and update these Terms at any time in our sole discretion. Any changes will be effective immediately upon posting to this page with an updated "Last Updated" date.
Your continued use of the Service following the posting of revised Terms means that you accept and agree to the changes.
