These Terms and Conditions ("Terms") constitute a legally binding agreement governing access to and use of the website (goball.app, goball.info), mobile application, and related services (collectively, the "Service") owned and operated by Taylor Gunn ("Owner," "we," "us," or "our"). By accessing or using the Service, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree, you must not access or use the Service.
1 Eligibility and Age Requirements
The Service is intended solely for individuals who are thirteen (13) years of age or older.
By creating an account or otherwise using the Service, you represent and warrant that you meet this minimum age requirement. Certain interactive or social features of the Service, including but not limited to the ability to post content, add friends, or directly interact with other users, may be restricted to individuals eighteen (18) years of age or older. Access to such features may require an affirmative opt-in or age verification.
We reserve the right, in our sole discretion, to restrict, suspend, or terminate access to the Service or any features thereof if we believe that a user has misrepresented their age.
2 Account Creation and Responsibilities
Access to certain features of the Service requires the creation of an account using a valid email address. You agree to provide accurate, current, and complete information during the registration process and to maintain and promptly update such information as necessary.
You are solely responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized access to or use of your account. We shall not be liable for any loss or damage arising from your failure to safeguard your account credentials.
3 Acceptable Use Policy
You agree that you shall not use the Service to:
- Violate any applicable federal, state, local, or international law or regulation;
- Harass, threaten, stalk, abuse, or otherwise harm any individual or entity;
- Post, transmit, or share content that is unlawful, defamatory, obscene, sexually explicit, hateful, or otherwise objectionable;
- Impersonate any person or entity, or misrepresent your affiliation with any person or entity;
- Upload, transmit, or introduce viruses, trojan horses, malware, or other malicious or technologically harmful material;
- Attempt to gain unauthorized access to, interfere with, damage, or disrupt any parts of the Service, the server on which the Service is stored, or any server, computer, or database connected to the Service;
- Use any robot, spider, crawler, scraper, or other automatic device, process, or means to access the Service for any purpose without our express written permission.
We reserve the right, but do not assume the obligation, to monitor activity and content on the Service and to remove content or restrict access at our sole discretion.
4 User-Generated Content & Moderation
The Service permits users to post, upload, or submit content, including sports logs, game notes, venue ratings, photos, and event plans ("User Content"). You retain full ownership of your User Content.
By submitting User Content to the Service, you grant us a non-exclusive, worldwide, royalty-free, transferable license to use, host, store, reproduce, display, and distribute such content solely in connection with the operation, promotion, synchronization, and improvement of the Service.
You represent and warrant that you possess all rights necessary to grant the foregoing license and that your User Content does not violate these Terms or infringe any third-party intellectual property or privacy rights.
4.1 Zero-Tolerance Policy
We enforce a strict zero-tolerance policy for objectionable, offensive, unlawful, harassing, or abusive content and behavior. Content that promotes hate speech, violence, sexually explicit material, harassment, threats, or defamation is strictly prohibited.
4.2 Reporting and Blocking Mechanisms
To ensure a safe and respectful community for all sports fans, the Service provides built-in safety tools:
- Blocking Abusive Users: You may block any user at any time using in-app controls. Blocking a user immediately and permanently hides their profile, friend connections, and shared content from your view.
- Flagging & Reporting Content: You may report objectionable content, reviews, or abusive accounts directly through the in-app reporting button or by contacting us at support@goball.app.
- Moderation Action: We review and investigate all user reports promptly, typically within forty-eight (48) to seventy-two (72) business hours. We reserve the absolute right to remove violating content and to immediately suspend or permanently ban accounts found to violate these standards without prior notice.
5 Intellectual Property
All content, source code, visual designs, trademarks, logos, features, and functionality of the Service (excluding User Content) are the exclusive property of Taylor Gunn and are protected by applicable United States and international copyright, trademark, patent, trade secret, and other intellectual property laws.
No right, title, or interest in or to the Service is transferred to you except as expressly set forth in these Terms.
6 Subscriptions, Payments, and Quotas
The Service operates on a freemium model with optional premium access provided through the GoBall Year One Supporter Pack:
Year One Supporter Pack: Available as an annual subscription for twenty-nine dollars and ninety-nine cents ($29.99 USD) per year, billed upfront. Pricing and billing terms are clearly disclosed prior to payment confirmation.
6.1 Feature Tiers & Quotas
- Free Tier: Includes logging and statistics for events occurring within a rolling three hundred sixty-five (365) day window, up to ten (10) photos per event at standard 1080p resolution, and up to two (2) active upcoming solo trip plans. Free accounts may view and participate in an unlimited number of shared trips created by other users.
- Year One Supporter Pack: Unlocks unlimited lifetime historical event logging, up to one hundred (100) photos per event at up to 4K resolution (images are preserved at their native resolution without artificial upscaling), unlimited solo and collaborative trip plans, and a permanent collectible Gold Year 1 Profile Border unlocked in your Collection locker.
- Video Uploads: Video uploads are currently not supported on any tier.
6.2 Storage Ceiling & Fair-Use Policy
Supporter accounts include a generous cloud storage ceiling of twenty-five gigabytes (25 GB) per account (sufficient for approximately 8,000 4K photos or 80+ events at maximum capacity). All uploaded media must consist of legitimate, user-generated sports, stadium, and event photos. Utilizing the Service for general-purpose file hosting, video dumps, or unauthorized cloud storage is strictly prohibited. Accounts exceeding fair-use limits may be subject to review or required to purchase additional storage capacity.
6.3 Anti-Spam & Event Creation Limits
To preserve database integrity and protect against automated abuse, accounts may log a maximum of five (5) events that took place on the same calendar event date. Users may backfill historical events across distinct calendar dates without restriction, subject to an automated technical ceiling of sixty (60) event creations per hour.
6.4 Billing, Auto-Renewal, and Cancellation
All payments, transactions, and renewals are processed through third-party payment processors (e.g., Stripe) or mobile application store platforms (e.g., Apple App Store / StoreKit).
- Automatic Renewal: Subscriptions automatically renew for successive one-year periods unless auto-renewal is disabled or canceled at least twenty-four (24) hours prior to the conclusion of the current billing cycle.
- Account Charging: Your Apple ID account or designated payment method will be charged at confirmation of purchase and on each annual renewal anniversary until canceled.
- How to Cancel:
- iOS Purchases: You may manage or cancel your subscription at any time via your device's Apple ID Account Settings > Subscriptions.
- Web Purchases: You may manage or cancel your subscription at any time via the Stripe Customer Portal accessible in your GoBall account settings.
- Cancellation Effect: Cancellation takes effect at the end of your current prepaid annual billing period. You retain full Supporter privileges through the expiration date.
6.5 Price Modifications
We reserve the right to modify subscription pricing for future billing cycles. Any price changes will apply prospectively to subsequent renewal terms, and we will provide you with at least thirty (30) days' advance notice via email or in-app notification prior to the change taking effect.
6.6 Downgrade & Data Retention Policy
If your subscription lapses or is canceled, your account transitions to the Free tier. Your existing data is never deleted: previously uploaded 4K photos, historical game logs, and archived trips remain safely stored in your account. However, creating new items that exceed Free tier quotas (e.g., adding an 11th photo to a new event, creating a 3rd active solo trip, or logging games older than 365 days) will be restricted until you renew or reduce existing usage below Free thresholds.
6.7 Refund Policy & Apple Standard EULA
Except as required by applicable law, all subscription purchases are non-refundable. For subscriptions purchased through the Apple App Store, all refund requests and billing inquiries are governed exclusively by Apple Support in accordance with Apple's policies. For web purchases, contact support@goball.app.
For users accessing the iOS application, your use of the Service is additionally subject to Apple's standard Licensed Application End User License Agreement (EULA).
7 Disclaimer of Warranties
The Service is provided on an "AS IS" and "AS AVAILABLE" basis. To the fullest extent permitted by law, we disclaim all warranties, whether express, implied, statutory, or otherwise, including without limitation any implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
We do not warrant that the Service will be uninterrupted, error-free, timely, secure, or that any defects or errors will be corrected.
8 Limitation of Liability
To the fullest extent permitted by law, in no event shall Taylor Gunn, affiliates, or licensors be liable for any indirect, incidental, consequential, special, or punitive damages arising out of or relating to your use of or inability to use the Service.
Our total cumulative liability for any and all claims arising under or related to these Terms or the Service shall not exceed the amount paid by you to us during the twelve (12) months preceding the event giving rise to the claim, or $50.00 USD if you have not made any payments.
9 Indemnification
You agree to defend, indemnify, and hold harmless Taylor Gunn from and against any and all claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to your violation of these Terms or your use of the Service, including your User Content.
10 Termination
We reserve the right, in our sole discretion, to suspend or terminate your account or access to all or part of the Service at any time and for any reason, including without limitation for violations of these Terms, without prior notice or liability.
You may terminate your account at any time through the profile settings in the app or by contacting support.
11 Governing Law and Venue
These Terms and any dispute or claim arising out of or related to them shall be governed by and construed in accordance with the internal laws of the State of Alabama, without giving effect to any choice or conflict of law provision or rule.
Any legal suit, action, or proceeding arising out of or related to these Terms or the Service shall be instituted exclusively in the state or federal courts located within the State of Alabama, and each party irrevocably submits to the exclusive jurisdiction of such courts.
12 Changes to These Terms
We reserve the right to revise and update these Terms at any time in our sole discretion. Any changes will be effective immediately upon posting to this page with an updated "Last Updated" date.
Your continued use of the Service following the posting of revised Terms means that you accept and agree to the changes.
